To each relevant work unit:
These requirements for enhancing administration of employing foreign nationals in Beijing shall be followed by each work unit in order to regulate the orderliness of employment of foreign nationals in Beijing, protect lawful rights and interests of both parties, and optimize a good environment for international talent aggregation in the capital city.
|一、加强外籍人员及用人单位的资质管理||1. Enhancing Administration of Foreign Nationals and the Qualifications of Work Units|
(1) Foreign nationals coming to Beijing for employment shall meet the following requirements:
1. be in good health condition, have no criminal record, and be between the ages of 18 and 60;
2. hold a bachelor’s or higher degree and 2 years relevant work experience. Foreign teachers should have 5 years or more of relevant work experience (language teachers are exempted); foreign nationals coming to Beijing without a bachelor’s or higher degree but who engage in urgently needed key technology research and development as senior level technicians, should obtain authentication of their foreign technology qualifications;
3. have a confirmed employer and hold a valid passport or other international travel certificate;
4. obtain an employment license and residence permit for employment. The scope of work shall not go beyond the scope indicated on the employment license.
In cases where our city’s economic and social development urgently needs talent that is in short supply, age restrictions and the required number of years of work experience may be relaxed. Starting from October 31, 2014, new applications for work licenses and work certificates by foreign teachers who are engaged in teaching kindergarten, primary and secondary school, international school and other kinds of educational institutions, must have teaching credentials issued by their own country. Language teachers who have no teaching credentials must obtain an internationally recognized language teaching credential.
(2) Work units (including education, scientific research, press, publication, culture, art, health, and sports) employing foreign cultural and educational experts, must obtain a Work Unit License to Hire Foreign Experts before the employment.
Beijing Human Resources and Social Security Bureau (Beijing Administration of Foreign Experts Affairs) should post a list of work units who have already obtained the Work Unit License to Hire Foreign Experts in Beijing. Work units who have obtained the Employment License for Foreigners shall display the Employment License for Foreigners in their public working area and foreground of the website homepage.
|二、用人单位应当落实好外籍人员管理服务的主体责任||2. Work Units Should Fulfill the Main Responsibilities of Administration and Service for Foreign Workers|
|（一）用人单位应当通过正规、合法渠道聘用外籍人员，与所聘外籍人员依法签订劳动合同，劳动合同期限不得超过5年，按规定为其缴纳社会保险，并保障其薪酬福利、劳动安全等合法权益，确保所聘外籍人员在劳动合同存续期间遵守中国法律法规。||(1) Work Units shall employ foreign nationals through formal and legal channels; sign labor contract with foreign nationals based on the law with the employment period not over than 5 years; pay social insurance and guarantee their legal rights and benefits, including wages, benefits, work safety, etc.; and ensure that foreign workers obey Chinese laws and regulations during the effectiveness of the labor contract.|
|（二）用人单位应加强内部制度建设，完善绩效考核、薪酬福利、安全防范和教育培训等管理制度；为所聘外籍人员建立包括劳动合同、有效护照和工作证件复印件、有效临时住宿登记单、国外无犯罪记录证明、日常考勤记录、社会保险缴费记录、工资发放记录等内容的工作档案；加强对外籍人员住宿登记管理，督促在旅馆以外的其它住所居住或住宿的外籍人员，依法在入住24小时内由本人或者留宿人，到居住地的公安机关办理登记手续；指定专人担任外籍人员工作事务专办员，专人履责，具体承担所聘外籍人员的手续办理、管理服务等工作，并保持专办员队伍的相对稳定。||(2) Work units shall concentrate on institutional improvement, improve management systems including job responsibilities, performance evaluation, wages and benefits, safety protection, education and training etc.; make work files for foreign workers, which include thelabor contract, copies of valid passport and work visa, valid temporary registration for residence, foreign non-criminal record certificate, daily record of work attendance, record of social insurance payment, record of payment etc.; enhance the management on foreign nationals’ temporary residence registration, supervise and urge those who reside or stay I places other than hotels to register at the public security authorities with jurisdiction over their place o f within 24 hours after taking up residence, in person or through the person who provides accommodations; designate a team to be responsible for employed foreign nationals’ affairs, including handling formalities, management and services, and assure the stability of the designated team.|
|（三）用人单位应建立外事应急预案，如所聘外籍人员发生人身意外伤亡事故、医疗卫生事故、经济安全事件以及其它突发情况，用人单位应启动外事应急预案，并及时上报区县和市级人力社保（外专）、外事、公安、教育等部门，不得隐瞒、缓报和谎报。||(3) The work unit should make foreign affairs emergency plans in case the employed foreign national is injured or dies, medical or health accident, economic safety or other unexpected incidents. Work units should report to district or municipal Human Resources and Social Security Bureau (Administration of Foreign Experts Affairs), Foreign Affairs Department, Public Security Bureau and Department of Education. No work unit should not hide, delay the report, or lie.|
|三、加强外籍人员工作证件的管理||3. Enhancing Management on Work Certificate of foreign nationals|
Work units shall arrange timely to apply for, change, extend or cancel foreign workers’ work certificates.
(1) Work units should apply to cancel foreign workers’ work certificate within 10 days after termination of the labor contract.
|（二）外籍人员擅自离职，超过15日未能取得联系的，用人单位应在公开媒体进行为期10日的公示，公示期满仍未取得联系的，用人单位应向市人力社保局（市外专局）提交证件注销书面申请；由市人力社保局（市外专局）在其官方网站进行为期10日的公示，公示期内，外籍人员本人未提出异议的，注销其工作证件。||(2) Work units should post an announcement in public media for 10 days if the foreign national leaves the job without authorization and cannot be contacted for over 15 days. Work units should apply in writing to the Beijing Human Resources and Social Security Bureau (Beijing Administration of Foreign Experts Affairs) for cancellation of the work certificate if there is still no contact exceeding the period of the announcement. The Beijing Human Resources and Social Security Bureau (Beijing Administration of Foreign Experts Affairs) will then post an announcement on its official website for another 10 days. If the foreign national states no objection during the period of the announcement, the work certificate will be cancelled.|
|（三）用人单位与所聘外籍人员签订的劳动合同期满，其工作证件即行失效。需要续订的，用人单位应当在工作证件期满前60日内，向原发证机关提出延长聘用时间的申请，经批准并办理工作证件延期手续。||(3) When the labor contract between work unit and the foreign worker expires, the work certificate will become invalid immediately. If renewal is needed, work units should apply to the original certificate issuance authority for employment extension approval within 60 days before expiration of the work certificate, and upon approval should follow the procedures for extending the work certificate.|
|（四）外籍人员所持签证证件、工作证件遗失、损毁、被盗抢的，或单位登记信息、外国人居留证件登记事项发生变更的，用人单位应当在10日内向原发证机关申请办理挂失、补换发或变更手续。||(4) If there is a loss, damage, theft or robbery of the foreign worker’s visa or work certificate, or any changes on registration information of work unit, or any changes on registration items of the foreign national’s residence permit, work units should apply to the original certificate issuance authorities for an loss report, replacement or change.|
|四、积极搭建外籍人员聘用公共服务平台||4. Actively Establishing a Public Service Platform for Foreign Nationals’ Employment|
|由市人力社保局（市外专局）牵头，积极开发境外高端人才资源，搭建全市外籍人员聘用供需信息平台，面向符合资质条件、有志来京工作的外籍人员，提供岗位信息、简历发布、就业政策等公共服务；定期组织对全市聘用单位开展包括国情、市情、出入境、签证居留、教育教学等内容的培训。用人单位应于每年12月上旬向市人力社保局（市外专局）报送下一年度外籍人员需求计划。||The Beijing Human Resources and Social Security Bureau (Beijing Administration of Foreign Experts Affairs) should actively develop overseas senior level talent resources, build up a city-wide informational supply and demand platform for foreign nationals, provide public services like job information, resume publishing, employment policies etc. to qualified foreign nationals who intend to work in Beijing; periodically hold trainings for work units that employ foreign nationals on national conditions, market conditions, exit-entry, visa and residence, education and teaching etc. Work units should report to Beijing Human Resources and Social Security Bureau (Beijing Administration of Foreign Experts Affairs) about next year’s plan for foreign nationals’ demand in early December each year.|
|五、加强监督检查与责任追究||5. Enhancing Supervision, Inspection and Accountability|
|（一）市人力社保局（市外专局）会同相关单位成立联合工作机制，动态会商外籍人员在出入境、证件办理、居留等方面的情况，实现信息共享；建立用人单位信用管理体系和外籍人员个人职业信用管理体系。加强对外籍人员聘用工作的考核监督，对于聘请外国文教专家的单位，考核结果与年检相挂钩，用人单位应当予以配合，提供真实、准确、有效的信息资料。对出现管理疏漏、侵犯外籍员工权益等问题的用人单位，市人力社保局（市外专局）会同相关部门，约谈其法定代表人或其授权代表，督促整改，强化管理。||(1) The Beijing Human Resources and Social Security Bureau (Beijing Administration of Foreign Experts Affairs) shall: set up a joint working mechanism with relevant work units to discuss foreign nationals’ exit-entry, certificate application, residence etc.; realize information sharing; establish a work unit credit management system and foreign national’s individual occupation credit management system. The Bureau (Administration) shall enhance evaluation and supervision of foreign nationals’ employment; link the evaluation of work units that employ foreign cultural and educational experts to the outcome of the units’ annual inspections. Work units should be cooperative to provide truthful, accurate and valid information. If a work unit has management omissions or infringement to foreign employee’s rights and benefits, the Beijing Human Resources and Social Security Bureau (Beijing Administration of Foreign Experts Affairs) should talk with its legal person or the authorized representative to urge its rectification and stronger management.|
|（二）对于外籍人员非法就业、介绍外籍人员非法就业，以及非法聘用外籍人员的单位和个人，人力社保部门配合公安部门依法予以查处。||(2) The Beijing Human Resources and Social Security Bureau will coordinate with Public Security department to investigate and punish foreign nationals who are engaged in illegal employment, work units or individuals who introduce foreign nationals for illegal employment, and those who illegally employ foreign nationals.|
|（三）对于拒绝人力社保部门检查工作证件、擅自变更用人单位、擅自更换职业、擅自延长工作期限的外籍人员，以及伪造、涂改、冒用、转让、买卖工作证件、资格证书的外籍人员和用人单位，由人力社保部门按照《外国人在中国就业管理规定》第二十九条、第三十条处理。||(3) For foreign nationals who refuse to have their work certificates inspected by the Beijing Human Resources and Social Security Bureau, change their employer and professions at will or extend their term of employment without permission, and for foreign nationals and employers that forge, falsely use, transfer, buy and sell the work permit and the employment license, the Beijing Human Resources and Social Security Bureau shall pursue their liabilities in accordance with article 29 and 30 of Rules for the Administration of Employment of Foreign Nationals in China.|
