为做好《中华人民共和国出境入境管理法》和《外国人入境出境管理条例》等法律法规的贯彻实施工作,进一步规范外国人在中国就业行为,人力资源社会保障部、外交部、公安部、文化部联合制定了《外国人入境完成短期工作任务的相关办理程序(试行)》(以下简称《办理程序》)。现印发给你们,请认真执行。 This Notice of Relevant Procedures for Foreigners Entering China for Completion of Short-Term Work Assignment (for Trial Implementation), (hereinafter referred to as “Procedures”) is jointly formulated by the Ministry of Human Resources and Social Security, Ministry of Foreign Affairs, Ministry of Public Security, and Ministry of Culture, for purpose of well implementation of the Exit-Entry Administration Law of the People’s Republic of China and Regulation on the Administration of the Entry and Exit of Foreign Nationals, and relevant laws and regulations, and further regulation of foreigners’ employment in China. The Procedures are now printed and distributed to you for your careful implementation.
各级人力资源社会保障、外事、公安、文化等部门应按照《办理程序》为入境完成短期工作任务的外国人办理相关手续。对于未按《办理程序》办理相关手续入境及不按工作证明所列事项从事短期工作的外国人,公安机关将按非法就业查处。各部门要逐步完善各项管理制度,加强协调配合,强化信息沟通,为入境完成短期工作任务的外国人提供便利。 The departments of Human Resources and Social Security, Foreign Affairs, Public Security, and Culture at all levels shall handle the procedures for foreigners who enter China for completion of short-term work assignments in accordance with these Procedures. Failure to follow these Procedures when entering China, or performing work not within the scope of the “Approval of Short-Term Employment” shall constitute illegal employment and be punished by Public Security Authorities. All departments shall gradually improve administrative systems, strengthen coordination and cooperation, and enhance communications to provide convenience to foreigners entering China for completion of short-term work assignments.
《办理程序》自 2015年1月1日起执行。请各部门抓紧做好执行前的各项准备工作。外国人在中国短期工作证明(中英文)和外国人短期工作信息表、外国人演出信息表电子模板另行发放。 These Procedures will be effective on January 1, 2015. All departments shall prepare well for implementation. The electronic templates of the “Approval of Short-Term Employment for Foreigners Working in China” (Bilingual), the “Foreigner’s Short-Term Work Information Sheet”, and the “Information Sheet on Performances by Foreigners” will be distributed separately.

外国人入境完成短期工作任务的相关办理程序(试行) Notice of Relevant Procedures for Foreigners Entering China for Completion of Short-Term Work Assignment (Trial)
一、外国人入境完成短期工作任务,指因下列事由入境,且在境内停留不超过90日的: ARTICLE 1. Entry by a foreigner for purposes of a short-term work assignment means entering China for the following reasons for a period of stay not exceeding 90 days:
(一)到境内合作方完成某项技术、科研、管理、指导等工作; (1) To complete certain technical, scientific research, management, supervisory, etc. work at a domestic partner’s unit;
(二)到境内体育机构进行试训(包括教练员、运动员); (2) To provide training in sports institution in China (including coach, or athlete);
(三)拍摄影片(包括广告片、纪录片); (3) Filming (including advertisements or documentaries);
(四)时装表演(包括车模、拍摄平面广告等); (4) Fashion shows (including modeling at car shows, shooting print advertisements, etc.);
(五)从事涉外营业性演出; (5) Engage in foreign-related commercial performances;
(六)人力资源社会保障部门认定的其他情形。 (6) Any other circumstances identified by department of Human Resources and Social Security.
二、以下情形不视为完成短期工作任务: ARTICLE 2. The following circumstances will not be considered a short-term work assignment:
(一)购买机器设备配套维修、安装、调试、拆卸、指导和培训的; (1) Repair, installation, adjustment, disassembly, or giving instructions or training in connection with the purchase of equipment or machinery;
(二)对在境内中标项目进行指导、监督、检查的; (2) Provide instruction, supervision or inspection to a project in China that has won a bid;
(三)派往境内分公司、子公司、代表处完成短期工作的; (3) Being dispatched to the branch office, subsidiary or representative office in China to complete a short-term work assignment.
(四)参加体育赛事的(包括运动员、教练员、队医、助理等相关人员。但根据国际体育组织要求,经我国主管部门批准,持注册卡入境参赛等情况除外); (4) participation in sports event (including athletes, coaches, team physicians or assistants, or other relevant personnel; the participation in sports events held in China with accreditation cards approved by competent departments of China according to the request of international sports organizations shall be excluded);
(五)入境从事无 报酬工作或由境外机构提供报酬的义工和志愿者等; (5) Entering China to engage in work without compensation, or to perform work as a volunteer, etc., receiving payment from a foreign organization;
(六)文化主管部门在批准文书上未注明“涉外营业性演出”的。 (6) The relevant cultural department has issued an approval document but it does not include an annotation stating, “foreign-related commercial performances”;
具有(一)(二)(三)(四)情形,且停留时间不超过90日的,应当申请办理M字签证;具有(五)(六)情形,且停留时间不超过90日的,应当申请办理F字签证。 In circumstances (1), (2), (3) or (4), where the stay in China will not exceed 90 days, the foreigner should apply for an M visa; in circumstances (5) or (6), where the stay in China will not exceed 90 days, the foreigner shall apply for an F visa.
三、前述第一条、第二条第(一)、(二)、(三)、(五)项所列人员每次入境停留时间超过90日的,均应按照《外国人在中国就业管理规定》申请办理相关手续。入境从事季节性劳务、短期劳务按有关规定执行。 ARTICLE 3. Foreigners entering China for purposes specified in Article1, or in paragraphs (1), (2), (3) or (5) of Article 2, for a period of stay over 90 days, shall follow the relevant procedures of Regulations of Foreigners’ Employment in China. Those entering China for seasonal labor or short-term labor shall follow relevant regulations.
四、入境进行短期营业性演出的外国文艺表演团体、个人应持有文化主管部门出具的批准文书及在中国短期工作证明(以下简称工作证明);入境完成其他短期工作任务的,应持有人力资源社会保障部门颁发的外国人就业许可证书(以下简称许可证书)及工作证明。 ARTICLE 4. Foreign art performance groups or individuals entering China for short-term commercial performances shall obtain the Approval Document issued by the culture administrative department and the Approval of Short-Term Employment (hereinafter referred to as “Approval”); Foreigners entering China for completion of other short-term work assignments, shall obtain an Alien Employment License (hereinafter referred to as “License”) issued by the department of Human Resource and Social Security and the Approval.
工作证明登记项目包括:持有人国籍和姓名、工作内容、工作地点、工作期限、签发日期等。 The registration items indication on the Approval shall include: holder’s nationality, name, work content, place and duration of work, date of issuance etc.
五、短期工作人员申请入境工作应按下列程序办理: ARTICLE 5. Foreigners applying for entry to China for a short-term assignment shall follow below procedures:

(一)申请工作许可

 

(1) Apply for a Employment License

 

1申请人力资源社会保障部门许可证书及工作证明

境内合作方拟邀请外国人入境从事短期工作的,应向省级人力资源社会保障部门或者其授权的地市级人力资源社会保障部门提出申请,并提交以下证明材料:

1. To apply for an Employment License and Approval issued by the department of Human Resources and Social Security, the domestic partner that intends to invite foreigners coming to China to engage in short-term work shall apply to the department of Human Resources and Social Security at the provincial level or the department of Human Resources and Social Security at city level authorized by the department of Human Resources and Social Security at provincial level, together with the following evidence:
(1)境内合作方登记证明、组织机构代码(均为复印件); (i) Domestic partner’s registration certificate and organizational code certificate (copies);
(2)中外双方合作协议、项目合同等; (ii) Co-operation agreement or project contract between China and the foreign party;
(3)拟入境人员简历; (iii) Resume of the foreigner intending to come to China;
(4)有效护照或其他国际旅行证件(复印件); (iv) Valid passport of other international travel document (copies);
(5)申请完成专业技术工作任务的外国人,应按国家规定提供相关学历或技术(职业)资格证明文件; (v) Foreigners applying to engage in professional and technical work assignments shall provide related degree or technical (professional) qualification certificates required by Chinese regulations.
(6)审批机关规定的其他证明材料。 (vi) Other evidence required by the examining and approving authority.
人力资源社会保障部门对入境短期工作事由明确、完整、合理,且没有违反国家法律法规者,发放许可证书及工作证明。 The department of Human Resources and Social Security shall issue the Employment License and Approval to those foreigners who have a clear, complete and reasonable reason coming to China for short-term work and who have not violated national laws and regulations.
外国人入境完成工作任务的地点涉及两个或以上省级地区的,应在境内合作方所在地的人力资源社会保障部门申请办理相关手续。 Foreigners entering China for completion of a work assignment at workplaces in two or more provincial-level areas, shall apply to the department of Human Resources and Social Security with jurisdiction over the domestic partner’s location.
各省级人力资源社会保障部门应在外国人入境前,将《外国人短期工作信息表》,以电子文档形式报送人力资源社会保障部。 All departments of Human Resources and Social Security at provincial level shall send the electronic format of the “Foreigners’ Short-Term Work Information Sheet” to the Ministry of Human Resource and Social Security before the foreigners’ entry.
2申请文化主管部门批准文书及工作证明 2. Applying to the culture administration department for the Approval Document and Approval
外国文艺表演团体、个人拟入境进行营业性演出的,应当由演出举办单位向首次演出所在地文化主管部门提出申请,文化主管部门应当根据《营业性演出管理条例》及其实施细则的规定,自受理申请之日起20日内作出决定。批准的,发给批准文书,并注明“涉外营业性演出”;不予批准的,应当书面通知申请人并说明理由。其中,拟入境进行营业性演出的外国文艺表演团体、个人,在境内停留时间不超过90日的,文化主管部门为其出具工作证明。演出增加地已列入工作证明的,演出增加地文化主管部门不再另行出具工作证明。 For foreign art performance groups or individuals intending to enter China for commercial performances, the performance hosting unit shall apply to the local culture administrative department at where the initial show will be hosted, the culture administrative department shall make a decision within 10 days after receipt of the application in accordance with the Regulations of Commercial Performances and its detailed rules for the implementation. The Approval Document shall be issued to those whose applications are approved, with an annotation of “foreign related commercial performance”; A notice shall be issued to those whose applications are denied, together with an explanation about the refusal. For foreign art performance groups or individuals who intend to enter China for commercial performances with stays of not more than 90 days, the culture administrative department shall issue the Approval to them. If additional places of performance have already been marked on the Approval, the culture administrative departments of these additional places do not need to issue another Approval.
演出所在地文化主管部门应在外国文艺表演团体、个人入境前,将《外国人演出信息表》通过涉外营业性演出审批信息公示系统报送文化部,文化部以电子文档形式抄送人力资源社会保障部。 The culture administrative departments of the places of performances shall submit the “Information Sheet on Performances by Foreigners” to the Ministry of Culture through the approval informational publicity system for foreign-related commercial performance before the foreign art performance groups or individuals enter China. The Ministry of Culture shall copy the form in electronic format to the Ministry of Human Resources and Social Security.
入境进行营业性演出的外国文艺表演团体、个人,完成短期工作任务后,拟继续在境内进行短期营业性演出的,演出举办单位应重新向文化主管部门申请工作证明,但工作时间不超过停留或居留许可有效期。审批手续依照本程序中“申请文化主管部门批准文书及工作证明”的有关要求办理。 After completion of a short-term work assignment, if the foreign art performance groups and individuals entering China for commercial performances intend to continue staying in China for short-term commercial performance, the performance hosting unit shall re-apply to the culture administrative department for an Approval, but the period of work shall not exceed the validity of the stay permit or residence permit. The relevant requirements in the “Application for Approval Document and the Approval at the competent departments for Culture” in these Procedures shall apply to the examination and approval procedures.
(二)办理邀请函或邀请确认函 (2) Apply for the invitation letter or invitation confirmation
用人单位持许可证书及工作证明到注册地或所属被授权单位申请办理邀请函或邀请确认函。 The employing work unit shall apply for an invitation letter or invitation confirmation at the place where the work unit is registered or at the authorized unit where the work unit belongs by providing the Approval Document and Approval.
演出举办单位持批准文书及工作证明到注册地或首次演出所在地省、自治区、直辖市政府外事部门,办理被授权单位邀请确认函。 The performance hosting unit shall apply for a Duly Authorized Unit’s Invitation Letter at the place of registration or at the foreign affairs department of the province, the autonomous region or municipality directly controlled by the central government where the initial performance will be hosted.
(三)申请Z字签证 (3) Apply for a Z visa
获准入境完成短期工作任务的外国人,应到中国驻外使馆、领馆或者外交部委托的其他驻外机关(以下简称驻外签证机关)申请Z字签证。申请人应提供以下证明材料: A foreigner whose entry to China for completion of a short-term work assignment is approved shall apply for a Z visa at the overseas China Embassy or Consulate or other overseas authority entrusted by the Ministry of Foreign Affairs (hereinafter referred to as Overseas Visa Authority). The applicant shall provide the following evidence:
(1)许可证书(批准文书)和工作证明的原件及复印件; (1) The original and copy of the License (or Approval Document) and Approval;
(2)被授权单位邀请函或邀请确认函; (2) The authorized unit’s invitation letter or invitation confirmation;
(3)本人护照或者其他国际旅行证件的原件和复印件; (3) The original and copy of a passport or other international travel document;
(4)驻外签证机关要求的其他材料。 (4) Other documents required by the Overseas Visa Authority.
驻外签证机关对许可证书(批准文书)原件和工作证明原件进行核验,留存复印件。对于工作证明中工作期限不超过30日的,驻外签证机关均签发停留期为30日的签证,同时在备注栏做双语备注“工作时间不得超出工作证明所注期限 Allowed to work only within the period of time indicated in the  approval ”;对于工作证明中工作期限超过30日的,签证备注栏中应注明入境后30日内办理居留手续。 The Overseas Visa Authority shall verify the original approval certificate and work certificate, and keep the copies. For a work period stated on the Employment License (or Approval Document) of less than 30 days, the Overseas Visa Authority shall issue the visa valid for a period of stay of 30 days, and make an bilingual annotation “工作时间不得超出工作证明所注期限 Allowed to work only within the period of time indicated in the  Approval” in the annotations section If the work period stated on the Approval is more than 30 days, the annotation on the visa shall state that a residence permit application should be filed within 30 days of entry.
与中国有互免签证协议国家人员,入境完成短期工作任务的,需在入境前获得工作证明,并持上述材料到我国驻外签证机关申请Z字签证。 Nationals of countries with reciprocal visa exemption agreements with China shall obtain the Approval before entering China, and apply to the Overseas Visa Authority for a Z visa with the above-mentioned documents, in order to enter China for completion of a short-term work assignment.
(四)办理工作类居留证件 (4) Apply for a work-type residence permit
工作期限不超过30日的短期工作人员,按工作证明上注明的工作期限工作,并在Z字签证中注明的停留期停留。工作期限超过30日的短期工作人员,按工作证明上注明的工作期限工作,并持工作证明、Z字签证等证明材料到公安机关办理停留期为90日的工作类居留证件。其中,外国文艺表演团体、个人可持工作证明和Z字签证等证明材料到演出举办单位注册地或首次演出所在地公安机关办理居留手续。已取得居留证件的外国演员在国内其他演出地演出,不再重复办理居留手续。 Foreigners entering China for short-term work for fewer than 30 days shall work according to the work period indicated on the Approval and stay in China within the period of stay indicated on the Z visa. Foreigners entering for short-term work for more than 30 days shall work within the period indicated on the Approval, and apply to the public security authority for a 90-day work-type residence permit by applying to the public security organs and submitting the Approval, Z visa, etc. Foreign art performance groups or individuals shall apply for residence permits to the local public security where the performance hosting unit is registered or where the initial performance will be held, submitting the Approval, Z visa, etc. Foreign artists who have already received residence permits and have performance in other places in China will not need to re-apply for residence permits.
六、其他事项 ARTICLE 6. Miscellaneous
(一)获得批准文书和工作证明的外国人取消工作任务未入境的,演出举办单位应及时函告文化主管部门;获得许可证书和工作证明的外国人取消工作任务未入境的,境内合作方应及时函告人力资源社会保障部门审批机关。 (1) For foreigners who have already received the Approval Document or Approval but need to cancel the work assignment before entering China, the performance hosting unit shall timely report in writing to the culture administrative department; for foreigners who already received the Employment License and Approval but need to cancel the work assignment before entering China, the domestic partner shall timely report in writting to the Human Resources and Social Security authority.
(二)外国人入境完成短期工作任务,其工作期限不得超出工作证明所注期限,工作证明到期后不延期。 (2) For foreigners entering China for completion of a short-term work assignment, the period of work shall not exceed the period indicated on the Approval. The Approval shall not be extended after its expiration.
持工作证明的外国人完成短期工作任务后,若其居留许可在有效期内,拟被境内用人单位聘用的,可按《外国人在中国就业管理规定》的有关程序在境内办理相关手续。 Where the residence permit of any foreigner with an Approval is still valid after his/her work tasks are completed and the domestic employer proposes to employ him/her, he/she may handle relevant procedures in China in accordance with relevant provisions of the Provisions on Employment Administration of Foreigners in China.
