Ley de Ciudadanía Infantil de 2000

Un niño nacido en el extranjero que actualmente reside en Estados Unidos como residente permanente se convierte automáticamente en ciudadano estadounidense si, en cualquier momento después del 27 de febrero de 2001, se cumplen todas las condiciones siguientes:

  • Al menos uno de sus padres es ciudadano estadounidense
  • El niño es menor de 18 años.
  • El niño reside actualmente de forma permanente en Estados Unidos bajo la custodia legal y física de su padre o madre estadounidense.

El niño puede solicitar un pasaporte estadounidense y/o presentar ante USCIS el Formulario N-600, Solicitud de Certificado de Ciudadanía.


Un niño nacido en el extranjero y que actualmente reside en el extranjero puede solicitar la naturalización si se encuentra temporalmente en Estados Unidos y se cumplen todas las condiciones siguientes:

  • Al menos uno de sus padres es ciudadano estadounidense.
  • El padre o la madre estadounidense ha estado físicamente presente en Estados Unidos durante al menos 5 años, de los cuales al menos 2 fueron después de cumplir 14 años; o dicho padre o madre tiene a su vez un padre o una madre estadounidense que ha estado físicamente presente en Estados Unidos durante al menos 5 años, de los cuales al menos 2 fueron después de cumplir 14 años.
  • El niño es menor de 18 años.
  • El niño reside fuera de Estados Unidos bajo la custodia legal y física de su padre o madre estadounidense.
  • El niño se encuentra temporalmente en Estados Unidos, tras haber ingresado legalmente, y mantiene un estatus legal en el país.

El niño puede presentar ante USCIS el Formulario N-600K, Solicitud de Ciudadanía y Expedición de Certificado bajo la Sección 322.
